RecMONEY Terms of Use

Welcome to Recmoney, a web service that brings borrowers and creditors closer together.

These Recmoney Terms of Use (hereinafter the ToUs) govern the relationship between the Company, or «we», and Internet users accessing Recmoney (the «Users», or «you»).

You are free to use Recmoney as provided in these ToUs and the Data Processing Policy. If you disagree with these ToUs, you should cease using Recmoney.

1. What is Recmoney?

Recmoney is a website available at https://recmoney.com (including all domain levels) via full and mobile versions, as well as a mobile app, presented as an agglomerate of intellectual property objects owned by the Company, and information (administration and user content), both located inside the information system («Recmoney»).

Recmoney is a platform for digital advertisements and/or offers posted or searched for by users in order to make deals.

The company provides authorized users with technical means to post information on the Recmoney platform as advertisements or offers. The company provides all users (no matter their authorization status) with technical means to search and browse Recmoney advertisements for the purposes provided in these ToUs. Recmoney′s automated algorithms process the inquiries in order to bring only the most relevant information in the form of search results.

The Company does not act as a party to any deal, a broker, a borrower or a lender with regards to any deals made by and between the platform users. Users use the information published on Recmoney to make deal at their own risk, without any direct or indirect participation or control by the Company.

2. Signing up to Recmoney

You can sign up to Recmoney using your mobile phone number or your social network profile provided as the Recmoney access form. After you sign up, we will set up your unique user profile. Recmoney can only have one user profile linked to one phone number at a time.

If you sign up for Recmoney using a social network, some functions will be restricted for you. In order for you to get access to the full range of our options, we may require you to provide your phone number, e-mail address, or verify your identity through the Unified Identification and Authentication System (ESIA).

By signing up to Recmoney and on each login, you guarantee that you have all the legal competences required to join to and fulfill these ToUs.

3. Recmoney login

You can log in to your Recmoney profile (sign in) using the phone number/e-mail address specified in your user profile or through the social network linked to your user profile (your login details). For the former, you have to enter your password, for the latter - log in to the social network in question.

Securing privacy of your Recmoney login details is your own responsibility. If you have reasons to believe someone has unauthorized access to those details, inform us about that immediately. All actions performed on Recmoney by anyone logging in using your login details, are considered your actions. You are responsible for them.

4. User data

All the data about yourself that you provide to the Company should be authentic, up to date and not in violation of any laws or third party rights. You have to update them as necessary using your Recmoney profile. We may ask you to provide documents to confirm your competences or to run security checks. If you do not provide such documents, we reserve the right to limit access to your user profile.

We can′t guarantee authenticity of all the information submitted by Recmoney users. Please exercise caution when making deals.

In some cases, we may ask you pass a security check or provide us with a way to do that on your own accord.

Security checks are necessary for us to fulfill our obligations under the contract we sign with you and to ensure safety of Recmoney users; we strive to provide a service that would make it easier for users to trust each other and make deals.

The documents you may be asked to provide for a security check may include a passport, a driver′s license, or a video feed of your face from multiple angles, with no voice or other sound transmission.

Documents are needed to verify the following:

1. That your profile was set up by a real person for the lawful use of Recmoney, as opposed to a one that was created automatically or owned by another user in the past but hacked in order to run some unlawful activities from it;
2. That a user has no problem providing extra details about themselves because they do not intend to run any unlawful activities (like swindling other users or wrongfully obtaining their contact details) or to avoid any liability for such activities.

A video feed of a user′s face may be requested in order to make sure that the user did not use someone else′s documents to pass a security check, or to verify that the user profile belongs to a real person and wasn′t created by an automated network.

By providing your passport and/or driver′s license and/or a video feed of your face for a security check, you consent to processing your personal data for that security check, as stated in the Data Processing Policy.

Recmoney can run multiple security check types, so a user can be asked to pass a single security check or several ones.

A successful security check does not guarantee that information a user specifies in their profile and advertisement is authentic and up to date, and does not constitute a recommendation for other users to make deals with that user. That information is for reference only.

If you fail a security check, your use of some of the Recmoney functions or access to your user profile may be restricted.

You only can pass a security check for a single Recmoney profile. Security checks are only available to users over 18.

We do not disclose user data (other than those available to the public) to any third persons, save for the cases when the law demands that (for example, at some government authorities′ request). Furthermore, we′re not responsible for wrongful actions of any third persons with regard to information you′ve made publicly available on Recmoney.

By signing up to Recmoney and on each login, you consent to:

1. Processing your subscriber data and the data on the communication services provided to you (like the phone number, subscriber device data, other communication service contract data) and handing the result of that processing over to us;
2. The Company handing over your phone number to partners who run user security checks for Recmoney.

Partners will not hand your data that constitutes secrecy of communication over to the Company.

A security check is needed so that the Company can provide you with technical means to create a Recmoney profile and publish information there, in order to protect other users′ interests, as well as to prevent and eliminate violations of law, ToUs and service contracts.

We analyze the ways you use Recmoney in order to make Recmoney better and help you measure your services′ performance.

5. User-generated content

User-generated content means texts and images published by Recmoney users in their advertisements, public profile sections and reviews. Reviewing and responding to reviews, you express your subjective opinions or evaluate interactions you have had or a deal you have made with another user.

The Company does not distribute user-generated content. You are the owner of all information you publish on Recmoney. You create, alter or make publicly accessible to indefinite number of persons all your content (including your personal data), without our input or approval.

If you publish your personal data in your public profile or advertisements, so that other users can contact you or get more details about your offer, you disclose it to an indefinite number of persons on your own accord. The Company processes your personal data in order to fulfill the contract we have signed with you, i.e. Recmoney Terms of Use.

If you publish third persons′ personal data on Recmoney or otherwise transfer such data to the Company, you guarantee that data follows all the applicable requirements of personal data laws, including, but not limited to, data storage security and providing the appropriate data subjects′ consent to such publishing, transfer or access.

It is your responsibility to ensure that your user-generated content fully complies to the law, the Recmoney Terms of Use, advertisement publishing rules and profile and review requirements. You guarantee that your content does not infringe on intellectual property rights of third persons.

Recmoney does not pre-moderate user-generated content. We take action with regard to content based on authorized persons′ request submitted as per the law.

The goal for the users publishing content on Recmoney is to come in content with prospective customers interested in buying advertised products. Knowingly publishing false information in the reviews or leaving any reviews for Recmoney vendors if you′re not interested in making a deal is not allowed; it is also unacceptable to use bot network to drive up the review numbers, including leaving paid reviews to improve a vendor′s rating. Collecting, copying, using or any other actions with user-generated content focused on any objectives not envisioned in these ToUs is not allowed. Users′ phone numbers are to be used strictly for the purposes directly related to deal negotiations.

You provide the Company with the right to use your content and intellectual properties included therein as a non-exclusive license: indefinite, free of charge, any use, all over the world, credited or non-credited. We can use your content to fulfill the ToUs, improve Recmoney, for advertisement or information purposes, in for profit or not for profit projects. We are entitled to store archive copies of user-generated content and to not delete materials that contain the same.

6. User communications at Recmoney

Authorized users can send messages in order to discuss deals. Using messages or phone calls for any other purposes, including to switch user communications to other messengers or channels through links to other websites, resources and Internet services is not allowed.

Messages or phone calls sent or made by users for purposes not provided in the ToUs violate the Personal Data Law and cause the Company to lose money.

We reserve the right to record, analyze and store messages. Messages sent through Recmoney user profile are not private. We reserve the right to review those messages selectively to ensure compliance with Recmoney ToUs and improvement of Recmoney.

7. Recmoney communications withe users

We may send to you:

• system messages you can not opt out of: sign up confirmation, notices on profile or advertisement access restrictions;
• service messages related to your actions at Recmoney, such as on messages received from other users or personalized advertisement selections;
• marketing and information messages such as Recmoney advice, invitations to take part in research, news and deals offered by Recmoney, the Company or our partners.

Messages may be sent to the message page in your user profile, to the phone number specified in your profile, as push notices on your device or as Recmoney messages. In some cases, we may contact you over the phone (for example to get feedback and improve our services).

You can manage service, information and marketing messages from your profile settings. The settings may vary depending on the device.

8. Deleting user profiles

You are entitled to delete your Recmoney user profile at any time by contacting the support service. Your profile will be deleted as soon as your cancel your offer contract (if you have one signed). If you don′t use your Recmoney profile for three years, it will be deleted.

For 30 days after profile deletion, you will not be able to use the phone number your specified for the deleted profile, to sign up again.

9. Copyright protection

Exclusive rights to software programs required to use Recmoney, databases, graphic interface (design) and other elements of the Recmoney website, brand name, trade marks/logos and other Company attributes, including those used in the Recmoney domain name.

The word Recmoney is a protected trademark used by the Company under a license agreement with the rights holder.

We reserve the right to apply Recmoney logos/watermarks over the photographs you upload, in order to protect our database materials from unlawful replication.

10. Database and software use license

We provide users with a non-exclusive license to use databases and software required to use Recmoney for the purposes stated in these ToUs. The license use is free of charge.

The license is provided from the moment you access Recmoney and remains valid as long as you keep using the service. Any users, no matter their sign up or authorization status, can search or browse advertisements. In order to have access to other Recmoney functions, you have to log in.

Using technical means to bypass the regular mode of database and software use without the Company′s approval is not allowed. In particular, using automated scripts to collect data from Recmoney or to create user profiles is not allowed.

It is not allowed to use databases and software for the purposes other than those provided in these ToUs. That means it is not allowed to retrieve data from databases and/or subsequently use it in any way or form, regardless of its volume or third party approval is such actions are not directly related to making a deal. For example, it is not allowed to use data from Recmoney databases to populate third party databases. it is also not allowed to use phone numbers from Recmoney databases to call Recmoney users with service or product offers. Those actions violate both the Company′s exclusive rights and users′ intellectual property rights, as well as constitute processing Recmoney users′ personal data without their consent.

11. Users′ obligations

When using Recmoney or interacting with the Company, you agree:

• to comply to all law requirements;
• to comply to the Recmoney Terms of Use, advertisement publishing rules, profile and review requirements, as well as to other Recmoney rules and Company instructions;
• not to call any Recmoney users if you′re not interested in making a deal offered in their advertisement; not to send spam messages;
• not to copy any Recmoney published information, including user-generated content, using automated means;
• not to use dirty language, images and statements that promote cruelty, hate or offensive attitudes, contain threats or abuse, justify violations of the law, break moral or business ethics norms;
• not to use Recmoney or information published on Recmoney for purposes not provided for in these ToUs.
• not to upload or use any harmful software;
• not to do anything that would interfere with normal functioning of Recmoney.

12. Violations and their implications

We strive to make Recmoney into a convenient and safe tool, and therefore reserve the right to run selective screening of the users′ conformance to Recmoney Terms of use at any time at our discretion. We may use automated methods to do that.

If any violations are discovered, we reserve the right to take appropriate steps or actions, using your profile or your technical means, to counteract unlawful behavior, violations of third party rights or Recmoney ToUs or Rules: to limit access to your user profile or some of the Recmoney functions, to delist your content from Recmoney searches, to hide your announcement on the map, to deny publishing your content or block it, to restrict access to Recmoney from certain IP addresses or phone numbers.

We can restrict access to user profiles if we receive any reports with regard to such profiles from other users, if profiles send spam messages, allow repeated or gross violations of Recmoney Terms or Use or Rules (including publishing fraudulent advertisements), if a profile has been hacked, if a user neglect to provide documents or information on our request, publishes misleading reviews, if a corporate user goes into liquidation, if we detect signs of fraud, pressuring other users to accept extra conditions, or if a user creates a new Recmoney profile to replace the one blocked earlier.

In exceptional cases, if a user fully corrects all previously committed violations, we may restore access to that user′s profile in order to uphold Recmoney user loyalty.

We are not responsible for any possible damages users may suffer as a consequence of any actions taken by us to prevent and counteract any violations of Recmoney use. We recommend you keep a backup copy of your content on your device.

You may incur criminal, administrative or civil liability for violating the law or third party rights when using Recmoney.

13. Final provisions

Articles 2, 3, 6 - 8 of these ToUs do not apply to registered users of Recmoney. All the other conditions apply equally to all users, regardless of their sign up or authorization status. Any interaction with Recmoney (including browsing) constitute your consent to these ToUs. The Company′s obligation to provide access to Recmoney functions are reciprocal with regard to your obligation to abide by the ToUs. Because using Recmoney is free of charge, consumer rights laws do not apply to the relationships between the Company and the platform users. Access to certain Recmoney functions may be subject to special conditions.

Recmoney functions may be altered, supplemented or discontinues at any time without a prior notice. Recmoney functions are offered «as is», i.e. their form and scope are such as the Company provides at the moment of their use. We are not liable for temporary failures and breaks in Recmoney functioning, or any data losses caused thereby. We are not liable for any indirect, consequential or inadvertent damages, including loss of profit or data, damage to reputation, integrity or image that Recmoney use may cause.

Recmoney may host links to third party websites. We neither control nor are responsible for those third party websites′ accessibility, lawful nature or content.

We update Recmoney Terms of Use as needed. We recommend you regularly visit the page they are published on: Recmoney.com.

By using Recmoney after a ToUs update, you consent to the changes made to them.
